- ADR - The term Alternative Dispute Resolution (ADR) represents various non-court and non-litigation methods to resolve civil disputes. ADR is aimed at saving time, money, and perhaps most importantly, the underlying relationship between the parties. ADR can be a valuable alternative to filing suit. Traditional forms of ADR include conciliation, mediation, and arbitration.
- Mediation - Mediation is a center point between negotiations and arbitration, or the possibility of a lawsuit. Mediation does not "force" a decision on the dispute, but instead helps to guide the parties to an agreed solution. Our mediation service is "interest based", to resolve and promote the interests of the parties. This does not necessarily mean a "win" in traditional terms, but could include preserving a business relationship, and help the "other side" to see your concerns and avoid future disagreements. Our process is called "facilitative", and we attempt to enable the disputing parties to reach their own agreement - a settlement that is both 1) proposed by the parties and 2) accepted by the parties.
- Arbitration - Arbitration, though similar to litigation in terms of structure and finality, allows the parties more flexibility than court-based proceedings, including permitting the parties to choose their own judge, or arbitrator (as the decision maker is known), they select their own timetable and their procedural rules. With multilateral conventions opening the way for use of arbitration and enforcement of arbitral awards, its inclusion in international contracts is becoming paramount to successful negotiations.
